범죄경력회보서 발급Guidelines for submission of “Criminal History and Investigation History Check Report” for issuance of APEC Business Travel Card (ABTC)
□ Basis
The Ministry of Justice revised the “APEC Business Travel Card Issuance and Management Regulations” based on the “ABTC International Operation Standards” (‘15.09.01.) Restricting issuance of cards to “those who have been convicted of a criminal case and whose sentence has not lapsed”
(Applicable from November 12, 2015 when the revised “Act on the Lapse of Criminal Sentences” goes into effect)
□ Application Period
Applicable from applications received on November 12, 2015 (excluding postmarks dated November 11, 2015)
※ If all original documents are not normally submitted by November 11, 2015 even after receiving a request for supplementation for previously received cases,
Additional submission of “Criminal History and Investigation History Check Report” is required
□ Additional submission documents
○ “Criminal Record/Investigation Record Inquiry Report” that can prove no criminal record (excluding expired sentences)
Issuance is restricted for those who have been convicted of a criminal case and whose sentence has not expired
※ ‘Effective sentence’ refers to a sentence that has passed the following period after the end of execution of the sentence.
– Imprisonment/imprisonment for more than 3 years: 10 years, Imprisonment/imprisonment for less than 3 years: 5 years, Fine: 2 years (from the date of payment of the fine)
○ When submitting new (replacement) application documents, be sure to seal the envelope and write “Criminal Record/Investigation History Inquiry Report”
○ Report validity period: Within 1 month from the date of issuance
□ “Criminal Record/Investigation History Inquiry Report” issuance method
1. Issuance in person at any police station nationwide (not including police boxes and district offices) (Issuance possible from: November 12, 2015)
According to Article 6, Paragraph 1, Item 4 of the 「Act on the Effectiveness of Criminal Sentences」
※ Purpose of inquiry: “For application for foreign entry/residence permit” (excluding expired sentences)
2. Issuance with a certified certificate: Address of the criminal record report issuance system http://crims.police.go.kr/
※ Purpose of inquiry: “For overseas entry/stay permit application” (excluding expired sentence)
※ For other specific matters regarding issuance of ‘Criminal Record/Investigation Record Inquiry Report’, please contact the National Police Agency or a nearby police station.
