The most important thing for tenants when signing a monthly rent or lease contract is how to protect the deposit. Since the deposit for jeonse is high, if the jeonse is not protected, big problems will arise. One of the systems that can protect tenants at this time is receiving a fixed date. Let’s learn more about how to obtain a confirmed date online from the Internet Registry Office site.

Occupying a leased location (moving)
If you set the three items above, you can be guaranteed priority under the Lease Protection Act. Reporting of move-in and moving to a leased location are often done according to the balance payment date, but the confirmed date can be received immediately even if the move-in report is not completed as long as the lease agreement is written.
There are two ways to receive a confirmed date for a contract: in person or online. In person, you can apply by visiting the local community center or registry office with your completed contract and ID card. This is possible even if it is not under the jurisdiction of the registry office. Internet applications, which are more convenient than in-person applications, can be made on the Internet Registry Office website. Let’s take a closer look at how to do that.

Difference between jeonse right establishment and confirmation date
When signing a lease, the lessor and lessee usually sign the contract at a real estate brokerage office. Because jeonse is a bond and not a real right, it is not recorded on the register. So, in order to secure priority bonds, it is necessary to set up a leasehold deposit, but most people do not do this because the costs and procedures are complicated.
Registration of jeonse right is a registration made by a person with a jeonse right to occupy another person’s real estate after paying the jeonse deposit and use it to make a profit according to the purpose of the property. Here, the person with the registration right is the person with the leasehold right, and the person obligated to register is the owner of the leasehold right. In order to apply for registration of jeonse rights, the registration right holder, registration obligor or agent must attend the registry office and apply.
The confirmed date refers to the date on which the lease agreement is stamped, that is, the date on which the housing lease agreement is concluded. The fixed date is subject to the Housing Lease Protection Act and has the nature of a bond, so it does not need to be entered in the register.
The biggest difference between the two is whether or not the landlord consents. A confirmed date can be granted by a lessee by presenting a contract without the consent of the lessor. On the other hand, establishing a leasehold right requires the consent of the lessor. There is the inconvenience of having to submit multiple documents, and in some cases, landlords may not give consent if they do not want their records to remain on the register.
There is a difference between the effective date of lease establishment and the confirmed date. The establishment of a leasehold right takes effect from the day the documents are received at the registry office. On the other hand, the confirmed date takes effect from the next day after all three items – possession of the house, report of moving in, and confirmed date – are met.
There are some differences in the protection methods for setting up a leasehold right and confirming a date. In the case of setting up a leasehold right, it usually only applies to buildings, and priority repayment is possible from the building’s successful bid price. On the other hand, on a fixed date, priority repayment is possible from the winning bid price of the building and land, and a certain amount of the deposit can be repaid with priority.
